How to Create a Contract

When beginning the contract process, it is important to ensure that the contract created is legal; beneficial for all parties, worded correctly, and that the terms for compliance are clear.
An agreement must have four essential elements to give rise to a contract and its respective obligations: offer, acceptance, consideration and an intention to create legal relations.
The basic elements required for the agreement to be a legally enforceable contract are mutual assent, expressed by a valid offer and acceptance; adequate consideration; capacity; and legality.
