Managers may feel tempted to call an employee back to work who has been on FMLA leave. Maybe the manager was extremely short handed or, maybe the manager felt the employee was ‚Äúmilking” the system. In either case, doing so is illegal.

Things to remember regarding the FMLA: You cannot demand someone to return work, you cannot inquire on the employees condition, employees have the right to return to the same role, you cannot hold an employees’ FMLA against them, and employees’ should never be harassed.
